What Is A CCJ And Should I Be Worried?

Understand what a County Court Judgment is, how it affects you and what options you have.

The Direct Answer

A County Court Judgment (CCJ) is a court judgment relating to an unpaid debt. A CCJ can affect credit records and may lead to further enforcement action if ignored. However, having a CCJ does not necessarily mean all options have disappeared.

Detailed Explanation

A County Court Judgment (CCJ) is a court order in England, Wales, or Northern Ireland that confirms you owe money to a creditor. It is usually issued when you have failed to respond to a County Court Claim or if you defended the claim but the judge ruled against you.

The most immediate impact of a CCJ is on your credit file. Unless you pay the full amount within one calendar month of the judgment date, the CCJ will be recorded on the Register of Judgments, Orders and Fines for six years. This will make it significantly harder to obtain credit, mortgages, or even some rental agreements and jobs.

If you did not know about the CCJ—for example, if the claim forms were sent to an old address—you might be able to apply to have the judgment "set aside." This does not wipe out the debt, but it removes the CCJ and puts the claim back to the beginning, allowing you to file a defence. If the CCJ is valid and you do not pay, the creditor can use enforcement methods like bailiffs or charging orders.

Common Mistakes

When dealing with complex procedures, panic or lack of clarity can lead to errors. Here are the most common mistakes people make:

  • Ignoring the situation hoping it will resolve itself.
  • Failing to seek professional guidance early enough.
  • Missing strict legal or procedural deadlines.
  • Communicating emotionally rather than factually.
  • Making informal agreements without getting them in writing.
